2. Accepting these terms
These terms apply to anyone who visits or uses the Website. By using the Website you accept them. If you do not agree to them, please do not use the Website.
If you use the Website on behalf of a business or other organisation, you accept these terms on its behalf.
3. What these terms cover
These terms cover access to and use of the Website only, including its pages, blog posts, case studies, downloadable resources and forms.
They do not cover any services, software or projects we provide to clients. Those are governed only by the separate written agreement we sign with each client. Nothing on the Website is an offer to provide services, and submitting a form or sending us an enquiry does not create a contract.
4. Changes to these terms and to the Website
We may update these terms from time to time. The date at the top of this page shows when they were last changed. Please check this page each time you use the Website, as the version in force on the day you use it applies.
We may update, change or remove any part of the Website at any time, for example to reflect changes to our business or our clients’ needs.
5. Accessing the Website
The Website is free to use. We do not guarantee that it, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict access to all or part of the Website for business or operational reasons, and we will try to give reasonable notice where we can.
You are responsible for the device, software and internet connection you use to reach the Website, and for making sure that anyone who accesses it through your connection knows about these terms.
6. Acceptable use
You may use the Website only for lawful purposes. You must not:
- use it in any way that breaks any applicable law or regulation, or that is fraudulent or harmful;
- try to gain unauthorised access to the Website, the server it runs on, or any connected system or database;
- attack the Website with a denial-of-service attack or deliberately introduce viruses, malware or other harmful material;
- use automated tools to copy, scrape or harvest the Website’s content or data in a way that places an unreasonable load on it, or to build a competing database;
- submit forms with false, misleading or automated information, or use them to send spam, unsolicited advertising or offensive material;
- impersonate any person or organisation, or misrepresent your connection with Voxly.
We may block or report anyone who breaks these rules. Attacks on the Website may be a criminal offence under the Computer Misuse Act 1990, and we may report them to the relevant authorities.
7. Intellectual property
We own, or are licensed to use, the intellectual property in the Website and its content, including text, images, videos, graphics, design and code. It is protected by copyright and other laws around the world.
You may view the Website, print or download extracts for your own reference, and share links to its pages. You must not otherwise copy, reproduce, republish, modify or commercially exploit any of the content without our written permission, and you must not use any illustrations, photographs, video or audio separately from the text around them.
Voxly, Voxly Digital and our logos are our trade marks. Client names, logos and brands shown in our case studies and elsewhere belong to their respective owners and appear for identification only. Showing them does not mean those owners endorse the Website.
8. Information on the Website
The content on the Website is provided for general information only. It is not professional, legal, technical or financial advice, and you should not rely on it as such. Please get advice suited to your circumstances before acting on anything you read here.
Case studies, statistics and results describe particular projects for particular clients. They are not a promise of the results any other organisation will achieve.
We work to keep the Website accurate and up to date, but we do not guarantee that its content is accurate, complete or current.
9. Forms and enquiries
When you contact us or request a resource such as an ebook through the Website, you must give information that is accurate and that you are entitled to share. We will use what you send us as described in our Privacy Policy.
10. Privacy and cookies
We handle personal information about you in line with our Privacy Policy, and we use cookies and similar technologies as described in our Cookie Policy. Both form part of these terms.
11. Links to and from the Website
The Website contains links to other websites and resources provided by third parties, such as Google Maps and our clients’ sites. We include them for your information only. We have no control over their content and are not responsible for it, or for any loss that may arise from your use of them.
You may link to the Website’s home page or any other page, as long as you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not link in a way that suggests any form of association, approval or endorsement on our part where none exists, and you must not frame the Website on another site.
12. Viruses and security
We take reasonable steps to keep the Website secure, but we do not guarantee that it will be free from bugs or viruses. You should use your own virus protection software.
13. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
If you are using the Website as a business: to the extent the law allows, we exclude all conditions, warranties and other terms that might otherwise apply to the Website or its content. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from your use of, or inability to use, the Website, or from your use of or reliance on any of its content. In particular, we will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss or damage.
If you are using the Website as a consumer: the Website is provided for private use only. You agree not to use it for any commercial or business purpose, and we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity. If defective digital content that we have supplied damages a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. We will not be liable for damage you could have avoided by following our advice to apply an update offered to you free of charge, or for damage caused by your failure to follow installation instructions or to have in place the minimum system requirements we advise. Nothing in these terms affects your statutory rights.
14. General
If any part of these terms is found to be unenforceable, the rest will remain in effect. If we do not insist on any of these terms straight away, or delay in taking action, that does not mean we have given up our rights.
These terms are between you and us. No other person has any rights to enforce them.
15. Governing law
If you are a business, these terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the law of England and Wales, and you and we both agree that the courts of England and Wales have exclusive jurisdiction.
If you are a consumer, these terms are governed by the law of England and Wales, and you can bring legal proceedings about the Website in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland, and if you live in Northern Ireland, you can also bring proceedings in Northern Ireland.
